California Privacy Addendum for California Residents

1. Introduction

 

This California Privacy Addendum supplements the information contained in Genesis Health Solutions, LLC's Privacy Policy and describes our collection and use of Personal Information. This addendum applies solely to all visitors, users, and others who reside in the State of California ("Consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, the "CPRA"). Terms defined in the CPRA have the same meaning when used in this notice.

 

2. Scope of This California Privacy Addendum

 

This addendum applies to Personal Information that we collect on our website and through our products and services when you use them. It does not apply to:

 

  • Employment-related Personal Information collected from California-based employees, job applicants, or contractors
  • Personal Information exempt from the CPRA, including health or medical information covered by HIPAA and the California Confidentiality of Medical Information Act (CMIA)
  • Clinical trial data
  • Publicly available information from government records
  • Deidentified or aggregated information

 

Protected Health Information (PHI) governed by HIPAA is covered under our separate Notice of Privacy Practices provided by Arora Health and Aesthetics Medical Group.

 

3. Information We Collect

 

Genesis Health Solutions collects, and over the prior twelve (12) months has collected, the following categories of Personal Information about Consumers:

Protected Classifications Age (40+); race; marital status; medical condition; physical or mental disability; sex (including gender, gender identity, gender expression, and sexual orientation).
Commercial Information Records of products or services purchased, obtained, or considered; subscription plan type; billing frequency; purchase history; and transaction identifiers.
Internet/Network Activity Browsing history; search history; information on your interaction with our website, application, or advertisement.
Geolocation Data IP-based information about your physical location or movements. This can identify your location to a geographic region (city, state, country) but cannot identify your precise location.
Financial/Payment Data Billing address; payment method type (e.g., Visa, Mastercard); payment method last four digits; transaction identifiers; subscription status; and renewal history. We do NOT collect or store full credit card, debit card, or bank account numbers.

 

Sensitive Personal Information

 

We may also collect the following categories of Sensitive Personal Information:

We will not collect additional categories of Personal Information without providing you notice.

 

4. Sources of Personal Information

 

We collect your Personal Information from the following sources:

 

  • Directly from you — when you register, enroll in a subscription, fill out forms, or contact us
  • Automatically — from your use of our website (cookies, analytics, device data)
  • From third parties — such as third-party laboratories when we receive test results, and from our service providers including payment processors

 

5. Purposes for Collection

 

We use your Personal Information for the purposes described in our Privacy Policy, including:

 

  • Maintaining and servicing accounts, including subscription accounts
  • Processing subscription enrollments, recurring billing, and renewal charges
  • Sending subscription confirmations, renewal reminders, and cancellation notices
  • Processing failed payments and dunning communications
  • Handling subscription cancellations and prorated refunds where applicable
  • Processing payments and fulfilling orders
  • Providing customer service
  • Performing analytics and reporting
  • Marketing and advertising (subject to your opt-out rights)
  • Detecting fraud and maintaining security
  • Complying with legal obligations

 

We will not use your Personal Information for materially different, unrelated, or incompatible purposes without providing you notice.

We disclose Personal Information to these third parties for the following business purposes: auditing; security and integrity; debugging; short-term transient use (non-personalized advertising); performing services on our behalf (including subscription management, billing, and payment processing); advertising and marketing (excluding cross-context behavioral advertising); and internal research and development.

 

We may also disclose any category of Personal Information to government entities or law enforcement when necessary to comply with laws, court orders, subpoenas, or to exercise or defend legal claims.

 

7. Sale and Sharing of Personal Information

 

We do not sell your Personal Information for monetary consideration. However, our use of advertising and analytics cookies may be considered a "sale" or "sharing" under the CPRA's broad definition, which includes exchange for "other valuable consideration."

 

  • "Sale" means the exchange of Personal Information for monetary or other valuable consideration. Our "sale" is limited to third-party advertising and analytics cookies used for behavioral advertising and understanding how people use our website.
  • "Sharing" means disclosure for the purpose of cross-context behavioral advertising (showing ads on other websites based on your browsing history with us).

 

Subscription and billing data is NOT sold or shared for cross-context behavioral advertising. Financial/payment data, commercial information (purchase history, subscription plan details), and government identifiers are disclosed only to payment processing service providers and business partners for the purpose of fulfilling your subscription — not for advertising purposes.

 

In the preceding twelve (12) months, we have "shared" (but not "sold" for monetary consideration) the following categories of Personal Information:

Minors Under 16: We do not have actual knowledge that we sell or share the Personal Information of minors under 16 without affirmative consent as required by the CPRA.

 

8. Your CPRA Privacy Rights

 

California residents have the following rights under the CPRA:

 

Right to Know

 

You may request that we disclose: (a) categories of Personal Information collected; (b) categories of sources; (c) purposes for collection; (d) categories of third parties with whom we shared; and (e) categories of third parties to whom we sold or shared your information.

 

Data Portability

 

You may request a copy of specific pieces of Personal Information we have collected about you in a portable, readily reusable format (if technically feasible).

 

Note: You must specify whether you are making a Right to Know request or a Data Portability request. If unclear, we will process as a Right to Know request. You may make each type of request up to two (2) times per 12-month period at no charge.

 

Right to Correct

 

You may request correction of inaccurate Personal Information. You may also correct some information yourself by logging into your account, including updating your billing address, payment method, and subscription preferences. We may require reasonable documentation to verify accuracy.

 

Right to Delete

 

You may request deletion of Personal Information we collected from you, subject to certain exceptions. Exceptions include: completing transactions, detecting security incidents, complying with legal obligations, maintaining subscriptions you have active, processing payments, and internal lawful uses compatible with the collection context.

 

Important: If you have an active subscription, deleting your account will also cancel your subscription. You will retain access until the end of your current billing period. Any data retained for legal, billing, or dispute resolution purposes will be maintained in accordance with our record retention policies.

 

Right to Opt-Out

 

If you are 16 or older, you have the right to direct us not to sell or share your Personal Information. If you are under 16, a parent or guardian may opt in on your behalf. Consumers who opt in may opt out at any time.

 

Right to Limit Use of Sensitive Personal Information

 

You have the right to limit the use and disclosure of your Sensitive Personal Information to what is reasonably necessary to perform the services or provide the goods expected by an average Consumer. See Section 11 for the purposes for which we use Sensitive Personal Information.

 

Non-Discrimination

 

We will not discriminate against you for exercising any CPRA rights. We will not deny services, charge different prices, or provide different quality of service because you exercised your rights.

 

9. How to Exercise Your Rights

 

Submit a Consumer Request by any of the following methods:

 

 

Your request must:

 

  • Provide sufficient information to verify your identity (e.g., information known only to you and us)
  • Describe your request with sufficient detail

 

Requests made through your password-protected account are considered sufficiently verified for information associated with that account. Making a request does not require creating an account.

 

Authorized Agents: You may authorize an agent to exercise your rights by providing written authorization or power of attorney. We may request proof of identity and authority.

 

10. How to Opt-Out of Sale or Sharing

 

You may opt-out of the "sale" and "sharing" of your Personal Information by:

 

  • Clicking the "Your Privacy Choices" button on our website footer
  • Configuring your browser to send a Global Privacy Control (GPC) signal (see globalprivacycontrol.org for configuration instructions)
  • Adjusting your browser cookie preferences

 

Once you opt out, we will wait at least 12 months before asking you to reauthorize sale or sharing. You may opt back in at any time by adjusting your cookie settings.

 

11. Sensitive Personal Information Use and Disclosure

 

We do not use or disclose your Sensitive Personal Information for purposes other than the following:

 

  • Performing services or providing goods reasonably expected by an average Consumer
  • Detecting security incidents
  • Resisting malicious, deceptive, fraudulent, or illegal actions
  • Ensuring safety of natural persons
  • Short-term, transient use (non-personalized advertising within current interaction)
  • Maintaining accounts, processing payments, providing customer service, analytics, or similar services

 

We may also use or disclose Sensitive Personal Information to comply with laws, court orders, subpoenas, regulatory inquiries, law enforcement cooperation, emergency access requests, and to exercise or defend legal claims.

 

Because we only use Sensitive Personal Information for these enumerated purposes, we are not required to provide a right to limit its use or disclosure under the CPRA beyond what is stated above.

 

12. Changes to This Addendum

 

We reserve the right to amend this addendum at any time. Updated versions will be posted on our website with an updated effective date. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.
