I. Who Is Genesis Health Solutions

 

Genesis Health Solutions LLC provides its users the ability to obtain lab testing, related results, and a telemedicine consultation provided by independent medical practitioners (“Medical Group”), an independent medical group with a network of United States-based health care providers (each, a “Provider”).  Genesis Health Solutions, LLC, is not a healthcare provider and does not practice medicine, it provides administrative, billing facilitator, and technology services. Clinical services are provided by licensed physicians employed or contracted by the Medical Group professional corporation.

 

II. What This Privacy Policy Covers

 

This Privacy Policy describes how we collect, use, and disclose consumer data through our website, mobile applications, and digital services. This includes personal information collected outside your direct treatment relationship.

 

This policy does NOT apply to Protected Health Information (PHI). PHI is governed by our separate HIPAA Notice of Privacy Practices. When you log into our secure patient portal, all information is treated as PHI.

 

Consumer data includes: Website browsing activity, cookies, newsletter signups, marketing preferences, survey responses not linked to treatment, social media engagement, analytics, and general account registration information.

  • Financial information related to Subscription billing (transaction identifiers, billing address, payment method type)

Your healthcare providers or family. With your consent, we may disclose your Personal Information, including Personal Information collected from your use of our Platform, with your health care providers and/or family members (e.g., immediate family or friends) that you designate to receive your Personal Information.

 

Other health-focused mobile apps. With your consent, we may disclose your profile information and data collected from your connected devices with other health-focused mobile applications installed on your mobile device to help you track your health and wellness information. If you share your information with these apps, your information, including your health information, will be used in accordance with privacy policies for those separate apps, not this Privacy Policy.

 

With your consent. We may disclose your Personal Information if you request or direct us to do so.

 

Compliance with law. We may disclose your Personal Information to comply with applicable law or any obligations thereunder, including cooperation with law enforcement, judicial orders, and regulatory inquiries.

 

Business Transfer. We may disclose your Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our users are among the assets transferred.

 

To enforce our rights. We may disclose your Personal Information to enforce any applicable terms and conditions and Terms of Use, and to ensure the safety and security of our Services and our users.

 

De-identified information. We may disclose de-identified information, so that it cannot be reasonably used to identify any individual, with third parties for marketing, advertising, research, or similar purposes.

 

Automated tools. We may use automated tools, including artificial intelligence, to assist in organizing, sorting, and structuring information into data fields for clinical and administrative purposes. For example, we offer Providers the ability to use a tool that assists in sorting and collating consultation information into structured data fields for documentation. These tools process information to perform a specific function and are not used to train artificial intelligence models. Any vendor providing AI-assisted processing tools that handles Protected Health Information is bound by a Business Associate Agreement under HIPAA.

 

To market our Products and Services. We may disclose your Personal Information with affiliates and third parties to market our Products and Services.

 

To market third party products and services. We may disclose your Personal Information with affiliates and third parties to market their products or services to you if you have opted-in of these disclosures. 

 

Third Party Analytics. We may use Digital Analytics to understand and evaluate how visitors interact with our Platform and/or the Services. These tools help us improve our Platform and/or the Services, performance, and your experience.

 

Subscriptions: We may disclose payment processing to partners who handle recurring billing, subscription management platforms, dunning/recovery services

 

We enter into contracts with third parties receiving your data requiring confidentiality and limiting use to the specified business purpose.

 

VI. Security

 

We implement reasonable administrative, technical, and physical safeguards to protect consumer data.  The internet is not 100% secure. We cannot guarantee absolute security but strive to use industry best practices.

 

VII. Your Choices and Rights

 

Marketing Communications: You may opt-out of marketing emails by clicking the unsubscribe link in any email. This does not apply to transactional or service-related communications.

 

Subscription management: In Genesis Health Solutions client portal: you may update payment methods, change Subscription plans, and manage billing communications.

 

Cookies and Tracking: You can configure your browser to refuse cookies or alert you when cookies are sent. However, disabling cookies may affect website functionality.

 

State-Specific Consumer Privacy Rights: Residents of California, Colorado, Connecticut, Utah, Virginia, and Washington have additional rights under their respective consumer privacy laws.

 

Rights typically include:

 

  • Right to Know: Request details about data collected, used, shared
  • Right to Delete: Request deletion of your personal data
  • Right to Correct: Request correction of inaccurate data
  • Right to Opt-Out: Opt-out of sale/sharing for targeted advertising

IX. Use of these Services

 

This Privacy Policy applies to personal uses of our Platform and is only available to users in the United States, and only in states where the Medical Group operates and its Providers are appropriately licensed. You should not use the Platform and/or the Services if you do not agree to the Privacy Policy and Terms of Use.

 

X. Minor's Privacy

 

We do not treat minors or knowingly collect personal information from anyone under 18. If we learn we've collected data from someone under 18, we will promptly delete it. Registration requires age attestation.

 

XI. Changes to This Policy

 

We may update this Privacy Policy at our discretion. Material changes will be posted on our website with an updated effective date. Continued use after changes constitutes acceptance. Review this page periodically.

 

XII. California Privacy Rights - Notice to California Residents

 

California residents please see our California Privacy Notice.  California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits users of our Platform and/or the Services that are California residents and who provide Personal Information in obtaining Products and Services for personal, family, or household use to request certain information regarding our disclosure of Personal Information to third parties for their own direct marketing purposes. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we disclosed your Personal Information with for the immediately prior calendar year (e.g. requests made in 2026 will receive information regarding such activities in 2025).
