This Washington Consumer Health Data Privacy Policy supplements the Genesis Health Solutions Privacy Policy and applies to personal data defined as "consumer health data" subject to the Washington State My Health My Data Act ("MHMDA"). This policy applies to individual consumers who are residents of Washington State or individuals whose consumer health data is collected in Washington State.
In the event of a conflict between any other policy, statement, or notice and this Consumer Health Data Privacy Policy, this policy will control as to consumer health data collected under the Washington MHMDA.
"Consumer health data" means personal information that is linked or reasonably linkable to a particular individual and that identifies that individual's past, present, or future physical or mental health status. The following categories are not consumer health data and are not covered by this policy:
Please note that data practices concerning Protected Health Information collected by independent medical practitioners (“Medical Group”), an independent medical group with a network of United States-based health care providers (each, a “Provider”) and its affiliates are described in the terms and privacy disclosures specific to those services, namely, the Provider’s Notice of Privacy Practices.
As described in the Privacy Policy, the data we collect depends on the context of your interactions with us and the choices you make (including your privacy settings), the products and features you use, and applicable law. Because consumer health data is defined very broadly, many of the categories of data we collect could also be considered consumer health data. We may collect the following categories of consumer health data with your consent or as reasonably necessary to provide a product or service you requested. Consent is obtained through your affirmative action, such as checking a consent box or signing a consent form during the enrollment process.
Examples of consumer health data we may collect include health information you voluntarily provide through intake forms or other information that may be used to infer or derive data related to the above or other health information.
As described further in our Privacy Policy, we collect personal data (which may include consumer health data) directly from you and from your interactions with our products and services, including from inferences from your activity using our services. We may also collect personal data (which may include consumer health data) from our business partners and service providers and from publicly available sources. We do not engage in geofencing within 2,000 feet of in-person health care facilities. We may receive approximate geolocation data from our payment processors (IP-based location that identifies your city, state, or country level region). This data is used for fraud prevention and payment authorization verification and does not include precise GPS coordinates or device-level location tracking.
We only collect and use consumer health data for the purposes described below. Primarily, we collect and use consumer health data as reasonably necessary to communicate with you and provide the products and services you have requested. We do not use your consumer health data for marketing or promotional purposes unless you have provided separate, affirmative, opt-in consent for that specific purpose. Your consent for marketing use is independent of any other consent you provide and is not a condition of using our services. You may withdraw your marketing consent at any time by contacting us at support@gen3health.com or by calling 877-343-8004 or through your account privacy settings. Upon withdrawal, we will cease using your consumer health data for marketing purposes within thirty (30) days.
To process and organize your information using automated tools, including artificial intelligence, that assist in sorting and structuring data into designated fields for clinical and administrative purposes. These tools perform specific processing functions and are not used to train artificial intelligence models on your consumer health data.

We may share consumer health data with your consent or as reasonably necessary to provide a product or service you have requested. "Share" under the Washington MHMDA means to release, disclose, disseminate, divulge, make available, provide access to, license, or otherwise communicate consumer health data to a third party. "Share" does not include: (i) disclosure to provide goods or services consistent with the purpose for which we collected the data; (ii) disclosure to a third party with whom you have a direct relationship for providing a product or service, where we maintain control and ownership of the data and the third party uses it only at our direction and consistent with your consent; or (iii) disclosure as part of a merger, acquisition, bankruptcy, or similar transaction in compliance with the Washington MHMDA.

How to Exercise Your Rights: Contact our privacy support team at support@gen3health.com with the subject line "Health Privacy Rights Request." You may submit a rights request, free of charge, up to two times per year. We will respond to verified consumer rights requests within thirty (30) days of receiving both the request and sufficient information to verify your identity. If we require additional time to process your request — due to the complexity of the request, the volume of data involved, or the need to coordinate with third-party processors — we may extend the response period by an additional thirty (30) days, for a maximum total response window of sixty (60) days. If we invoke an extension, we will notify you within the initial thirty (30) day period, explain the reason for the extension, and provide an estimated completion date
Appeals: We will respond to your appeal within forty-five (45) days of receipt. If your request is denied, you may appeal by contacting support@gen3health.com. If your appeal is unsuccessful, you may raise a concern with the Washington State Attorney General at www.atg.wa.gov/file-complaint.
Under the WA MHMDA defines a “sale” as the exchange of consumer health data for monetary or other valuable consideration, excluding exchange (i) to a third party as an asset that is part of a merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of our assets that complies with the requirements and obligations in the WA MHMDA; or (ii) by us to a processor when such exchange is consistent with the purpose for which the consumer health data was collected and disclosed to the consumer. As required by law, we only sell consumer health data after we have obtained a valid authorization from the consumer whose consumer health data is involved in the sale. If you have previously authorized us to sell your consumer health data, you can revoke that authorization at any time by contacting us at support@gen3health.com for information on how to revoke your authorization.

We reserve the right to amend this policy at any time. If any proposed change would result in the collection, use, or sharing of new categories of consumer health data, or would expand the purposes for which your existing consumer health data is used or shared, we will obtain your separate, affirmative opt-in consent prior to implementing such changes. Your continued use of our website or services does not, by itself, constitute consent to any new or expanded collection, use, or sharing of your consumer health data. For changes that do not expand the scope of consumer health data processing — such as administrative updates, contact information changes, or formatting revisions — the updated policy will take effect upon posting, and we will indicate the revised effective date at the top of this policy.
